According to the criminal complaint, on May 1, Black purchased a Smith & Wesson M&P 15 rifle from the Ladysmith Ace Home Center in Ladysmith, Wisconsin. Black obtained the money to buy the rifle for Kyle Rittenhouse to use. Rittenhouse, 17 at the time of the purchase, was not legally able to purchase the rifle for himself. Aware of this fact, Black purchased the weapon. Since Rittenhouse was a minor and did not have an Illinois firearm owner ID card, he and Black agreed that the rifle would be stored at the residence of Black's stepfather, located in Kenosha.

On Aug. 23, a Kenosha police officer shot a Black man named Jacob Blake, and over the next few days, protests erupted around town. During some of these protests, the complaint states various businesses and property was damaged. Responding to the unrest, the city enacted an evening curfew. On the evening of Aug. 25, Black volunteered to go out after curfew armed with another rifle of the same make and model, with the goal to protect the Car Source business located in the city. Black asked Rittenhouse to join him, and they both went to Black's stepfather's residence to retrieve the rifle Black was reserving for Rittenhouse.

Then, at about 11:49 p.m. on Aug. 25, Rittenhouse used the rifle that been given to him by Black to kill two unarmed individuals, Joseph Rosenbaum and Anthony Huber. Rittenhouse shot Rosenbaum four times in the parking lot located on the 6200 block of Sheridan Road. A few seconds later in the 6000 block of Sheridan Road, Rittenhouse shot Huber in the chest one time, killing him. The 17-year-old also used the rifle to shoot another man, Gaige Grosskreutz, in the arm. Both killings were captured on video by witnesses who were present during the protests, and the videos were widely shared on social media.

According to the complaint, Rittenhouse admitted to killing both individuals to Black that evening and also later confessed to the killings to the Antioch Police Department.

Rittenhouse faces first-degree intentional homicide and attempted intentional homicide charges in Wisconsin in connection to the shootings. His bail is set at $2 million.
