Man who stole expensive hemp plants from Bay County farm gets probation - mlive.com

BAY CITY, MI — A man accused of stealing a pair of valuable, though THC-lacking, hemp plants from a Bay County farm along with his brother and another man has received a probationary sentence.

Bay County Circuit Judge Harry P. Gill on Monday, June 8, sentenced Mario A. Khoury, 24, to one year of probation. The judge ordered 365 days in jail held in abeyance, meaning Khoury will only have to serve the time if he violates probation. Gill gave him credit for two days already served.

Gill also ordered Khoury to pay $258 in fines and costs.

The charges stem from an incident that occurred the night of Oct. 18. About 8:30 p.m., the owner of a hemp farm in Monitor Township noticed suspicious activity on surveillance cameras overlooking a crop field and notified a security guard, police reports contained in court records show. The guard responded and spotted a white Chevrolet Avalanche drive away from a field.

Bay County Sheriff’s deputies stopped the Avalanche on southbound Interstate 75 minutes later. It had a non-functioning taillight.

The Avalanche contained Khoury and two others, court records show.

Mario Khoury, of Saginaw, opened the Avalanche’s rear door and showed deputies two hemp plants, their stems spray-painted orange. Deputies searched the vehicle and found a loaded 9mm handgun in the center console, as well as two machetes, court records show.

Mario Khoury apologized to deputies, saying he and his brother had been out target shooting earlier in the day and he’d forgotten the gun was there, police reports state.

Mario Khoury told deputies he had been on a nearby Skyweb Networks Wi-Fi tower on Seven Mile Road when he “saw what looked to be a marijuana field,” court records show. He said they went to take some, only to be chased away.

Farm staff showed deputies surveillance camera footage of the incident, which depicted two men enter the field, each holding an object, then return to the Avalanche with the plants. Staff also said about 60 plants had been stolen on Oct. 14, prompting them to spray-paint orange on the stems of the remaining ones in case they were stolen, police reports state.

The farm’s owner told deputies the plants are valued at $1,000 each. The owner also told deputies the hemp he grows does not contain THC, the active ingredient in marijuana. Hemp is a type of cannabis that contains 0.3 percent or less of THC by dry weight, according to experts. The plant can be used to create CBD oil, textiles, paper, and can be used in soaps and cosmetics.

Demo Demosthenous, vice president of Skyweb, previously told MLive the trio did not work directly for Skyweb and were independent contractors. He added that they did not have work done on Wi-Fi towers at the time the trio claimed to be working on the nearby tower.
