Judge says bakery can refuse to make same sex wedding cake

A judge has ruled that a California bakery can continue to refuse to make a wedding cake for a same-sex couple. 

The ruling allows Tastries Bakery Cathy Miller to continue to refuse to bake a wedding cake for Mireya and Eileen Rodriguez-Del Rio. 

The couple filed a complaint last fall claiming the bakers refusal violated a law that prohibits public businesses to deny service to anyone based on gender, race, religion or sexual orientation. 

"A wedding cake is not just a cake in Free Speech analysis," said the judge on his ruling. "It is an artistic expression by the person making it that is to be used traditionally as a centerpiece in the celebration of a marriage." 

The judge's ruling stands until the case goes to trial.
